No mobile information will be shared with third parties/affiliates formarketing/promotional purposes. All the above categories exclude text messagingoriginator opt-in data and consent; this information will not be shared withany third parties.

Security of your personal information

When we collect and process personal information, and while we retainthis information, we will protect it within commercially acceptable means toprevent loss and theft, as well as unauthorized access, disclosure, copying,use, or modification.

HIPAA compliance

To the extent that is applicable to your use of the Services orotherwise, the Health Insurance Portability and Accountability Act of 1996 (HIPAA)provides safeguards to protect your privacy. These safeguards may includerestrictions on who may see or be notified of your Protected Health Information(PHI). These restrictions do not include the normal interchange of informationnecessary to provide you or your family with treatment. HIPAA provides certainrights and protections to you. We must balance these needs with our goal ofproviding you with quality service and care. For this reason, we have adoptedthe following policies:

·     To the extent that is applicable, PHI will be kept confidential except asis necessary to provide treatment or to ensure that all administrative mattersrelated to you are handled appropriately. Your files may be stored in open fileracks but will not contain any coding which identifies any medical condition orinformation which is not already a matter of public record. The normal courseof providing care means that such records may be left in administrative areassuch as the front office, etc. You agree to the normal procedures utilized withinour facilities for the handling of charts, patient records, PHI, and otherdocuments or information.

·     We utilize a number of vendors in the conduct of our business. Thesevendors may have access to PHI but agree to abide by the confidentiality rulesof HIPAA. In all these cases, we will have a HIPAA business associate contract inplace with our vendors, as applicable. This means they understand the federalHIPAA guidelines for confidentiality and agree to abide by those regulationsset forth and maintain the same level of confidentiality that healthcareprofessionals are bound to in the event they should encounter patientinformation. Careful steps will be taken with our accountant and IT vendor toensure they rarely encounter any client information. Our Electronic MedicalRecord Systems (EMR) vendor will be used tomaintain patient records. In both cases, bank level security and encryption isused to protect client information. Their systems will also electronicallyautomated and vendor support reps are only accessed if a data input error occurred.Support staff of the EMR vendor will have restricted access and will not beable to access patient narrative notes. Our EMR vendor, like most EMR vendors,will have authority to use de-identified patient information. They will do thisin compliance with HIPAA guidelines to ensure any data extracted for researchpurposes can in no way be identified to a client.

·     You understand and agree to inspections of our locations and the reviewof documents, which may include PHI by government agencies or insurancecompanies in the normal performance of their duties.

·     You agree to bring any concerns or complaints regarding privacy to ourattention.

·     Your confidential information will not be used for the purposes ofadvertising or marketing of products, goods, or services. Such prohibition doesnot include treatment/product samples or goods of nominal value.

·     We agree to provide you with access to your records in accordance withstate law. We may change, add, delete, or modify any of these provisions tobetter serve the needs of both you and our practice. You hereby agree to theterms set forth above and any subsequent changes in LIV’s policy and understandthat this consent shall remain in force so long as you are using any of theServices.

Who May Have Access to YourInformation

Within LIV: We may disclose certain of your personal information to our affiliatesand personnel who need to know the information for the purposes describedabove, including personnel in the customer service and information technologydepartments.

Third-Party Service Providers: We may use third party serviceproviders acting on our behalf to perform some of the services described above.For example, we share certain information with our EMR vendor to maintainpatient records and with other service providers who assist with the processingof credit cards and payments, hosting, managing and services our data,distributing emails, conducting research and analytics, advertising, analytics,or administering certain services and features. We also may share informationabout you with our professional advisors, including accountants, auditors,lawyers, insurers and bankers, if needed. These service providers may changeover time, but we will always use trusted service providers who we require totake appropriate security measures to protect your personal information in linewith our policies. We only permit them to process your personal information forspecified purposes and, as appropriate, in accordance with our instructions andthe provisions of this Policy and applicable law.

Data Retention
